1) Reservations & Rental Agreement: Please return this signed rental agreement two weeks prior to your stay. If Window To The Woods Lodge does not receive this rental agreement 14 days prior to your stay, you will not gain access to the property, your reservation will be canceled, and all rental fees will not be refunded. All reservations are accepted and subject to availability changes that may be beyond the control of Window To The Woods Lodge. Changes that could effect your reservation, but are not limited to, damage to the rental property which make it unsuitable for occupancy. Our liability is limited to the return of your deposit and any rental payments made, regardless of the reason for the unsuitable occupancy, if this should occur.
2) Deposits: Deposits for Window To The Woods Lodge can be made via paypal.com, or by check or money order.
3) Payment: Full Payment is required 14 days prior to your arrival date.
4) Cancellation of Reservations: 1. 6 months or more prior to reservation. All monies paid will be returned (less $50 handling fee). 2. 3 - 6 months prior to reservation. All monies paid will be returned (less $50 handling fee) if and when the cancelled time is rented. 3. Less than 3 months prior to reservation. No refund of deposit will be returned.
5) ALL RENTALS ARE TO FAMILIES AND RESPONSIBLE ADULTS ONLY. Tenant acknowledges that he/she will personally occupy the property for the entire lease period and will not sublet any portion of the property. Occupancy restricted to the maximum occupancy as set forth in this lease. Violation of any of these terms shall give right to termination. Tenant agrees that the premises shall not be used for any illegal or unlawful purpose.
6) Items Not Supplied: Tenants are required to bring their own food & linens (flat/fitted sheets, towels, washcloths, toiletries). Master Bedroom /King Size, Jr. Suite / Queen Size, Bunk Room / 8 Twin Size, and all paper products (toiletries, paper towels, etc.).
7) Occupancy: Renter should understand that the property is intended to be used by the maximum specified number of persons shown above and allowed for the property they are renting. Inclusion of additional persons beyond the specified maximum, could result in extra charges and could result in early termination of you rental period without refund of rental fees paid.
8) Responsibilities: The Applicant agrees to take full financial responsibility for the actions and/or damage caused by any member of their party, or invited guests.
9) Check-In/Check-out: Check in is 3:00 P.M. Check-out is 11:00 A.M. No exceptions. Time is needed to inspect the property for the next guests.
10) CARE OF PROPERTY. Tenant is expected to care for the property as if it were their own. All damages or concerns to the property during the occupancy will be Tenants responsibility and must be reported and paid for if needed prior to departure. Rearranging of furniture is not permitted. Tenant must leave the property in a clean condition to include the following: All trash removed from the lodge, inside and out. Due to wild animals, trash must be taken with you when you leave. All dishes & kitchenware must be washed and put away. Refrigerator must be clean and all food removed. Stove must be cleaned. Bathrooms must be cleaned, including toilets, tubs, showers, sinks and floors. All floors must be swept and free of dirt, mud, etc. All doors and windows must be closed and locked. Beds should be made with comforters and pillows. All extra pillows and blankets should be returned to the closets. All telephones must be returned to their chargers. All keys must be returned to the lock box by check out time. All breakage or malfunction must be reported to the office. Lodge must be left in the same clean condition as you found it. If the lodge is left dirty or littered, inside or out, you will be charged an additional cleaning fee. Failure to comply will give Window To The Woods Lodge the right to deduct appropriate sums from the special deposit plus a $35.00 processing fee prior to returning the balance to Tenant. You will be charged for anything on this list that is not completed prior to check out.
11) Inventory: Inventory is completed for each home before your arrival and inventoried upon your departure. Any missing or damaged inventory will be charged against your security deposit.
12) Malfunctions: Service requests for televisions, jacuzzi's, appliances, bathrooms, plumbing, etc...... will be responded to as quickly as possible. There are no rebates or refunds issued to Tenants for any reason as every good faith effort is made to insure the property is maintained to highest standards.
13) Fireplace Usage: Tenants may use indoor fireplace. Logs from the outdoor woodpile, along with any dead, downed wood or brush may be used. No live trees, bushes or plants can be cut down. Tenants may use the fireplace fan to distribute heat from the fire. The fireplace fan can be turned on using the knob to the left of the fireplace. Tenants must also OPEN fireplace flu located directly above the fireplace. Both the flu and the fan have directions posted on them as well. Cold ash must be removed from the fireplace at the end of your stay. Please place ash in the metal trash can provided and place outside. *Do not place hot ash indoors. The fumes from the ash are fatal.
14) Telephones: are provided. Tenant may make unlimited calls within the local exchanges. Calls out side of the local area or information request calls are available only through the use of a personal calling card. Absolutely no toll phone charges for any reason whatsoever. If any toll charges are accepted, the renter shall pay for the call and pay a $25.00 processing fee. Please place all three telephones back on their chargers.
15) Locked areas: for which Tenant is not provided a key, such as owners personal storage areas, are exempt from this lease agreement and are off limits to the Tenant. Forced entry into these areas is cause for immediate termination and Tenant will be charged for damage and/or missing items.
16) Lost, stolen or abandoned articles: Owner shall not have any responsibility for lost, stolen or abandoned items. There will be a $25.00 plus shipping fee for any returned items.
17) Supervision of Children: All children should be supervised at ALL times. Window To The Woods Lodge is not childproof. Adults / Parents / Guardians should use extreme caution and guidance when allowing children use of the Lodge and its surrounding land.
18) Mountain Terrain / Trails / Woods / Stream Areas: Tenant hereby acknowledges that Window To The Woods is located on 12+ wooded acres complete with trails, streams, woods, and steep hills. The undersigned is fully aware that injuries can occur in these areas and the use of these areas are at the renters own risk. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to activities and daily use of the above 12+acres. The stairs leading to the stream are to be used at your own risk. The can become slippery when wet and/or leaf covered!
19) Firearms / Hunting: Absolutely no firearms or weapons of any type are permitted for use on the property. There is absolutely No Hunting on the property or the surrounding land.
20) Fires: No Outdoor Fires are permitted.
21) Non-smoking: Smoking is permitted outside only. Cigarettes are to be disposed of properly. Absolutely no cigarette butts are to be thrown on or around the Window To The Woods Grounds! A fee will be charged to clean-up any cigarette butts found on the property. We request that you respect these rules.
22) Pets are Not Permitted without written Landlord approval.
23.)ADDITIONAL TERMS AND CONDITIONS: The Tenant agrees to release and indemnify the Owner from and against all liability, should anyone be injured upon the premises during the term of the lease, resulting from any cause whatsoever. Window To The Woods / Ryan Wagner / Jennifer Wagner does not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will Window To The Woods /Ryan Wagner / Jennifer Wagner accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control. The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owners( Ryan & Jennifer Wagner) from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom.
Guest(s) hereby agrees to INDEMNIFY and hold Window To The Woods / Ryan Wagner /Jennifer Wagner harmless of any and all claims including those of third parties, arising out of, or in any way related to Guest(s) use of premises or the items of personal property therein. Guest(s) assumes the risk of injury or other losses relating to their stay at Window To the Woods Lodge.
I/we have read in entirety the above rental agreement and by signing below agree to all above conditions, terms and rules set forth by Window To The Woods Lodge / Ryan Wagner / Jennifer Wagner. I/we understand that this is a guaranteed reservation.
